Preamble
RAW ENGINEERING, under the Bad Winners brand, is organizing a promotional operation allowing its customers to win a motorcycle. This operation requires the prior purchase of a product from the "Scrambler 1100 Edition" collection: it therefore involves a purchase obligation, of which the customer is informed before placing an order.
This document sets out its rules. It is governed by French law. Any person taking part in the operation accepts it in full.
Article 1 — Organizer
1.1 The operation is organized by RAW ENGINEERING, a simplified joint-stock company (SAS) with capital of 114,639 euros, whose registered office is located at 7 place de l'Hôtel de Ville, 93600 Aulnay-sous-Bois, registered under number 982 069 163 with the Bobigny Trade and Companies Register (SIRET 982 069 163 00011). It is hereinafter referred to as the "Organizer".

Article 2 — Purpose of the Operation
2.1 The operation, entitled "Scrambler 1100 Edition" and hereinafter referred to as the "Operation", is intended to promote the collection of the same name as well as the Organizer's business.
2.2 It consists of a prize draw at the end of which the motorcycle described in Title III is awarded to one of the participants.
2.3 Participation requires the purchase of an eligible product within the meaning of Article 5. No other means of participation is available.
Article 3 — Schedule
3.1 Orders giving entitlement to participate may be placed from September 7, 2026 to October 19, 2026 inclusive. This period is hereinafter referred to as the "Participation Period".
3.2 If all units offered for sale, i.e. 2,500 units across all colors, sell out before October 19, 2026, the Participation Period ends early on the date the stock is exhausted.
3.3 The prize draw takes place on October 21, 2026. It may be brought forward in the event of early closure within the meaning of Article 3.2. It may not be postponed beyond this date, subject only to Article 23.3.
Article 4 — Eligible Participants
4.1 Any individual aged eighteen or older on the date of their order and residing in a European Union member state may participate.
The cost of shipping the T-shirt and, where applicable, the cost of transporting the Prize from the collection location mentioned in Article 12.1, remain the responsibility of the participant, under the conditions set out in Article 13.2.
4.2 The following may not participate:
- employees and directors of the Organizer, as well as their spouse, ascendants, and descendants;
- any person who has taken part, directly or through a third party, in the preparation or conduct of the Operation;
- service providers involved in its organization.
4.3 The Organizer may ask a participant to prove their identity, age, or address. An inaccurate statement voids the participation.
Article 5 — Product Giving Entitlement to Participate
5.1 The purchase, during the Participation Period and on the online store accessible at https://www.badwinners.com (hereinafter "the Store"), of the "Scrambler 1100 Edition" T-shirt gives entitlement to participate.
5.2 This T-shirt is offered in two colors, black and white, both of which give the same entitlement to participate.
5.3 No other product sold on the Store gives entitlement to participate.
Article 6 — Participant's Procedure
6.1 To participate, the customer must, during the same order process:
- add at least one eligible T-shirt to their cart;
- check the box requesting to take part in the prize draw;
- read and accept these rules;
- validate their order and proceed with payment.
6.2 The box mentioned in Article 6.1 is separate from the one by which the customer accepts the terms and conditions of sale. It is never pre-checked.
6.3 A purchase does not therefore automatically constitute participation. A customer who wishes to purchase the T-shirt without entering the prize draw may do so: they simply need to leave this box unchecked.
6.4 The Organizer will send the participant confirmation of their participation by email or WhatsApp message.
Article 7 — Number of Entries
7.1 Each eligible T-shirt purchased during the Participation Period gives rise to one entry.
7.2 The number of entries is not capped. The same customer may purchase several T-shirts and have as many entries, within the limit of available stock.
Article 8 — Void Entries
The following entries are excluded from the prize draw:
- incomplete or irregular entries with regard to these rules;
- entries from a person who does not meet the conditions of Article 4;
- entries linked to a canceled order or one that has been the subject of a withdrawal;
- entries obtained through fraudulent means.
Article 9 — Prize Description
9.1 The prize offered, hereinafter referred to as the "Prize", is a DUCATI Scrambler 1100 motorcycle fitted with the Bad Winners Motokit. Its value is estimated at 15,990 euros, all taxes included.
9.2 Its main features are as follows:
- make and model: DUCATI Scrambler 1100;
- year: 2018;
- mileage: 2,000 km;
- color: carbon;
- equipment: Bad Winners Motokit.
This list is not exhaustive. The vehicle is delivered in the condition it is in on the day of collection.
9.3 The Prize is awarded in kind. It may not be transferred, exchanged, or converted into cash, and the winner may not claim its cash equivalent.
9.4 If the Prize were to become unavailable for a reason beyond the Organizer's control, the Organizer would replace it with an item of comparable value, and the winner may not raise any claim on this basis.
Article 10 — Prize Draw
10.1 A single prize draw is held on the date set in Article 3.3, among all valid entries recorded during the Participation Period.
10.2 It is carried out by a judicial officer (commissaire de justice), using a random drawing process, to guarantee equality among participants and the transparency of the operation.
10.3 The draw designates one winner, followed by two alternates called in the order drawn.
Article 11 — Notification and Acceptance by the Winner
11.1 The Organizer will notify the winner by email or telephone within fifteen days of the draw, and will inform them of the conditions for collecting the Prize.
11.2 The winner has thirty days from this notification to confirm their acceptance of the Prize.
11.3 If this deadline passes without a response, or in the event of refusal, incapacity, or ineligibility, the Prize will be offered to the first alternate, then to the second. If neither can receive it, the Prize remains the property of the Organizer.
Article 12 — Collection of the Prize
12.1 The Prize will be held available to the winner at 67 avenue de Verdun, 77470 Trilport, for a maximum period of two months from acceptance.
12.2 The winner must attend in person with a valid form of identification and the message by which they were notified of their win.
12.3 If they intend to ride the vehicle away, they must also present a valid category A or A2 driving license. Failing that, they may have the Prize collected by any appropriate means, in particular by trailer or carrier, at their own expense.
12.4 A collection report is drawn up and signed by the winner.
Article 13 — Costs
13.1 The Organizer bears the vehicle registration costs when the winner is domiciled in France. In other cases, these costs, as well as responsibility for registration procedures, fall to the winner.
13.2 A winner domiciled outside France also bears all approval and roadworthiness inspection procedures required to put the vehicle into circulation in their country of residence.
13.3 The winner remains responsible for insuring the vehicle, their travel costs, any transport of the Prize, and the maintenance and use of the vehicle from the time of collection.
13.4 The winner undertakes to insure the vehicle before putting it into circulation and to comply with traffic regulations.
Article 14 — Right of Withdrawal
In accordance with Article L. 221-18 of the French Consumer Code, the customer has fourteen days from receipt of their product to exercise their right of withdrawal. This right may be exercised freely; these rules place no restriction on it and do not subject its exercise to any condition.
Article 15 — Consequences for Participation
15.1 Participation in the prize draw is based on the purchase of an eligible product. Cancellation of the order or withdrawal by the customer therefore retroactively voids the associated entry, whenever it occurs.
15.2 Where the order covered several products and the customer returns only part of them, only the entries attached to the returned products are affected.
15.3 An entry voided in this way cannot be transferred to another order or give rise to compensation.
Article 16 — Consequences for the Prize
16.1 If the withdrawal occurs after the prize draw and its author had been designated the winner, the win is forfeited and the Prize is offered to the first alternate.
16.2 If the Prize had already been handed over, the winner must return it at their own expense, in the condition in which they received it. If they are unable to return it in that condition, they must pay the Organizer the value mentioned in Article 9.1.
16.3 These provisions constitute neither a penalty nor an obstacle to the exercise of the right of withdrawal. They merely draw the consequences of the disappearance of the purchase to which the entry was attached.
Article 17 — Fraud
17.1 The Organizer may exclude from the Operation, without notice or compensation, any participant whose behavior is fraudulent or abusive, who fails to comply with these rules or the Store's general terms, who provides inaccurate information, or who attempts to alter the conduct of the draw by any means whatsoever.
17.2 Attempted fraud may result in legal proceedings.
Article 18 — Liability
18.1 The Organizer is not responsible for being unable to reach the winner where this is due to incorrect, incomplete, or outdated contact details.
18.2 Nor is it responsible for:
- errors affecting the information provided by participants;
- the loss, theft, or deterioration of the Prize after it has been handed over;
- damage occurring during use of the Prize;
- failures of participants' networks or computer equipment.
18.3 Driving a motor vehicle requires an appropriate license, insurance, and compliance with traffic regulations. The Organizer is not responsible for the consequences of the winner's use of the Prize.
Article 19 — Modification, Suspension, and Cancellation
19.1 The Organizer may shorten, suspend, or cancel the Operation, in particular in the event of fraud, force majeure within the meaning of Article 1218 of the French Civil Code, or any event beyond its control that jeopardizes the conduct of the draw.
19.2 It may also extend the Operation or modify its terms under the conditions set out in Article 23.3.
19.3 Any modification will be brought to participants' attention on the Store and will result in an amendment being filed with the judicial officer.
19.4 These decisions do not give rise to any compensation.
Article 20 — Personal Data
20.1 The Organizer processes participants' last name, first name, postal address, email address, and phone number in order to record entries, carry out the prize draw, and hand over the Prize.
20.2 This data may be transmitted to the judicial officer and to the logistics provider, for these purposes only.
20.3 It is retained for one year after the close of the Operation for non-winning participants, and for five years for the winner, in order to meet accounting obligations.
20.4 Each participant has, under the conditions set out in Regulation (EU) 2016/679 and the French Data Protection Act of January 6, 1978, the right to access, rectify, erase, restrict, and object to the processing of their data. This right may be exercised by contacting contact@badwinners.com.
20.5 They may also lodge a complaint with the French Data Protection Authority (Commission nationale de l'informatique et des libertés — www.cnil.fr).
Article 21 — Communication About the Operation
21.1 The Operation is announced on the Store as well as on the Organizer's Instagram and Facebook accounts.
21.2 The winner authorizes the Organizer to mention their first name followed by the initial of their last name in communications about the Operation, unless they object.
21.3 Any other use of their image or identity requires their written consent.
Article 22 — Intellectual Property
The elements that make up the Operation — its name, visuals, communication materials, and these rules — belong to the Organizer. Reproducing or exploiting them without authorization exposes the offending party to legal proceedings.
Article 23 — Filing and Availability of the Rules
23.1 These rules are filed with SELAS ACTA - Commissaires de Justice associés - 25 bd Joffre 54000 NANCY - Office de Metz 15 rue de Sarre BP 15126 57074 METZ Cedex 3. They may be sent free of charge to anyone who requests them from the organizing company.
23.2 They may also be freely consulted on the Store, at https://www.badwinners.com/pages/reglement.
23.3 The organizing company reserves the right to extend, shorten, modify, or cancel its operation at any time, in particular in the event of force majeure, without participants being entitled to claim any compensation. Article 24 — Acceptance of the Rules
24.1 Participating in the Operation entails full acceptance of these rules, as well as the Store's terms and conditions of sale and use.
24.2 Questions raised by the interpretation or application of these rules will be examined by the Organizer, without prejudice to any participant's right to bring the matter before the competent court.
Article 25 — Governing Law and Disputes
25.1 These rules are governed by French law.
25.2 Disputes arising in connection with the Operation that cannot be resolved amicably fall under the jurisdiction of the competent French courts.
